Terms of Service

Acceptance of Terms

By accessing or using THE LINE (“the Platform”), operated by Jarrod Heaney (“we”, “our”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

We reserve the right to update these terms at any time. Continued use following any changes constitutes acceptance. Registered users will be notified of material changes via email.

Service Description

THE LINE is an Operational Human Performance platform delivering adaptive-periodised training programs for firefighters, military personnel, police, paramedics, tactical athletes, and hybrid athletes. The Platform uses readiness data — sleep quality, HRV, RPE — and user-provided metrics to generate personalised training recommendations. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without liability.

User Obligations

  • You are at least 18 years of age, or have obtained verifiable parental consent.
  • You will provide accurate, complete, and current information when registering and using the Platform.
  • You are solely responsible for maintaining the confidentiality of your credentials and all activity under your account.
  • You will not use the Platform for any unlawful purpose or in violation of applicable Australian law.
  • You will not attempt to reverse-engineer, decompile, scrape, or otherwise extract proprietary components of the Platform.

Account Responsibility

You are responsible for all activity conducted through your account. Notify us immediately of any unauthorised access or security breach at support@theline.ag. We are not liable for any loss arising from your failure to maintain account security.

Payment Terms

The Platform is currently in pre-launch. Future subscription tiers, pricing in Australian Dollars (AUD), billing cycles, and cancellation policies will be communicated prior to implementation. Subscriptions are non-transferable. We reserve the right to amend pricing with reasonable notice to active subscribers.

Intellectual Property

All content, branding, trademarks, software, training methodologies, program designs, and the periodisation engine within THE LINE are the exclusive intellectual property of THE LINE and Jarrod Heaney. You receive a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent.

Limitation of Liability

To the maximum extent permitted by Australian law — including the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law) — THE LINE, its founder, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill arising from your use of the Platform.

Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months preceding the claim, or AUD $100. Nothing in these terms excludes or limits any rights under the Australian Consumer Law that cannot be excluded by agreement.

Fitness Disclaimer

Warning: Physical training carries inherent risks including serious injury, illness, and death. THE LINE provides training guidance for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. You expressly assume all risks associated with any training program generated by the Platform. Consult a qualified physician before beginning any exercise program. THE LINE is not liable for any injuries or health issues arising from your use of the Platform.

Termination

We may suspend or terminate your account at our sole discretion — without prior notice — for conduct that violates these terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions relating to intellectual property, limitation of liability, and governing law survive termination.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under these terms. If any provision is found to be unenforceable, the remaining provisions continue in full effect.
